Please read these Terms of Service carefully before using oowah. By accessing or using our service, you agree to be bound by these terms. If you do not agree, please do not use our service.

1. Acceptance of Terms

By creating an account, making a purchase, or using any part of the oowah service available at oowah.net (“Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. These Terms constitute a legally binding agreement between you and oowah (“we,” “us,” or “our”).

If you are using our Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

oowah is an AI-powered Japanese language learning service designed specifically for travelers preparing for trips to Japan. The Service includes:

• Personalized study plan generation based on your travel profile and learning preferences
• AI conversation practice through free talk and scenario-based lessons
• Structured lesson courses covering travel-relevant situations
• Progress tracking, conversation history, and performance evaluation
• A 30-minute free trial for new registered users

The Service is intended for educational and personal use in preparation for travel. It is not a substitute for professional language instruction or translation services.

3. Account Registration

To access paid features, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

You must be at least 13 years of age to create an account. Accounts are for individual use only and may not be shared with others.

4. Purchases and Access

Access Tickets

Access to paid features is granted through time-limited tickets purchased via our website. Available options:

• 7-Day Pass: $10.00 USD — 7 days of full access
• 30-Day Pass: $29.00 USD — 30 days of full access

Access begins immediately upon successful payment confirmation. Tickets are non-transferable and apply only to the purchasing account.

Free Trial

New registered users are entitled to one 30-minute free trial of the AI conversation features. The free trial is available once per account and cannot be reset or transferred.

Payment

All payments are processed securely by Stripe. We accept major credit and debit cards. By making a purchase, you authorize us to charge the applicable fees to your chosen payment method.

Refunds

Refund requests are handled in accordance with our Refund Policy, which is incorporated into these Terms by reference.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Attempt to gain unauthorized access to any part of the Service or its related systems
• Share, resell, or transfer your account access to any other person
• Use automated tools, bots, or scripts to access or interact with the Service
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Use the AI conversation features to generate harmful, illegal, or offensive content
• Submit false, misleading, or fraudulent information
• Violate any applicable local, national, or international law or regulation
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

6. AI-Generated Content

Our Service uses artificial intelligence, including OpenAI’s GPT models, to generate language learning content and conversation responses. Please be aware that:

• AI-generated content may occasionally contain errors, inaccuracies, or unnatural phrasing
• The Service is designed for general travel preparation and may not cover all regional dialects or highly specialized vocabulary
• AI responses should not be relied upon as a sole source of information in emergency situations
• We make no guarantee that completion of any study plan will result in a specific level of language proficiency

We continuously work to improve the quality and accuracy of AI-generated content, but we cannot guarantee perfection.

7. Intellectual Property

All content, design, software, and materials comprising the Service — including lesson content, scenario scripts, interface design, and branding — are the intellectual property of oowah or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial learning purposes during the validity of your access ticket.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Service without our prior written consent.

Conversation data that you generate through the Service (your messages) remains yours. By using the Service, you grant us a limited license to process and store this data for the purpose of providing and improving the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or free of viruses or other harmful components
• Warranties regarding the accuracy, reliability, or completeness of any content provided through the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OOWAH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or if continued provision of the Service is not feasible.

You may terminate your account at any time by contacting us at oowah.net@gmail.com. Termination does not entitle you to a refund of any unused access period, except as provided in our Refund Policy.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

12. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will notify you by email or prominent notice on our website at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes.
